Application to Reserve an IDD Unit

Three Oaks Communities (TOC) and iStrive Community, Inc. (iStrive), a 501(c)3 non-profit organization, are partnering to design and deliver the best possible experience for the Intellectually and Developmentally Disabled (IDD) residents of our Magnolia Oaks neighborhood located in Middletown, New Jersey. The information requested in this Application will help us to achieve that goal.


All prospective IDD residents must complete this Application. For your Application to be considered complete, you must:


  • Complete and sign this Application form, including providing contact information for a reference to complete the Reference Form

  • Complete a background check consent and application

  • Pay all required fees when due as outlined in the Deposits and Fee section of this Application


Your Application, Reference, and New Resident Profile will then be reviewed and sent to the Magnolia Oaks HOA who will approve, deny, or request more information about your Application. TOC is the acting HOA Board at this time.


All fields with an asterisks (*) are required fields. Your Application will not be accepted without the required information requested.


If you have more than one IDD Individual that you will be submitting an Application for, you must complete a separate Application, Reference, and New Resident Profile for each individual.

Acknowledgements and Consents

At the end of this section, you must confirm that you have read, understand, and accept each of the statements below for your Application to be accepted.


References to "I", "me", "you" and "your" refer to the person(s) completing this Application.

General

  1. I acknowledge that the information I am providing will be kept confidential and only shared with authorized staff of TOC and its affiliates, and designated members of iStrive. Any other use will require my prior consent.

  2. I acknowledge that the information I am providing will be used for programmatic planning, identifying potential housemates, and to assess the support I or my loved one may require to safely reside in Magnolia Oaks.

  3. I provide my consent for the HOA to conduct a background check, at its expense, on me and the Individual(s) included in this Application that want to reside in Magnolia Oaks.

  4. I acknowledge that upon approval of my Application the Magnolia Oaks HOA and iStrive may request a more in-depth profile including medical history, health professional contact information, emergency contacts, service and support needs, and other personal information.

  5. I acknowledge that TOC is committed to providing equal housing opportunity for all persons, regardless of race, color, national origin, religion, age, sex, familial status, marital status, or disability.


Approvals and Residency Requirements

  1. I acknowledge that my Application requires that all individual(s) who will reside in any IDD Unit must have an Intellectual or Developmental Disability (IDD), unless otherwise approved in advance by the Magnolia Oaks HOA Board.

  2. Safety is our #1 priority. I acknowledge that the HOA may deny any Application if, in its sole discretion, it determines that the prospective resident with IDD presents a safety risk to themselves, others, or the property of others.

  3. I acknowledge that approval of my Application will require HOA approval as authorized in the Magnolia Oaks HOA Bylaws. I may appeal the HOA's decision, who's decision will be final.

  4. I acknowledge that this Application does not constitute a reservation or purchase agreement.

  5. I acknowledge that the Magnolia Oaks HOA may reconsider my Application if it finds any material misrepresentations in the information provided.


Services

  1. I acknowledge that TOC or iStrive will not be providing or coordinating direct care services and that TOC and iStrive cannot guarantee what level of support that the Division of Developmental Disabilities (DDD) may authorize for any resident of our neighborhoods.

  2. I acknowledge that TOC's neuro-inclusive housing model requires that residents self-determine what services they require. As such, it is my responsibility to work with my Care Coordinator to select a service provider and secure all authorizations.

  3. I acknowledge that if I require direct care services that I may be required to select the same Service Provider as others living in the same IDD Unit. If direct care services will be paid for using DDD funds, the Service Provider I select must also be authorized by the Division of Developmental Disabilities (DDD) of the NJ Department of Human Services. If private pay, it is my responsibility to ensure that the provider(s) I choose are qualified to deliver the services rendered.


Financial Planning and Benefits

  1. I acknowledge that I am solely responsible for any impact on Social Security, Medicaid, or any other government benefits that may result from owning an IDD unit in Magnolia Oaks.

  2. I acknowledge that is my responsibility to consult a qualified financial advisor, government benefits specialist, or other trusted professional before entering into a Reservation Agreement or a Purchase Agreement for an IDD unit in a TOC neighborhood.

  3. I acknowledge that TOC will require a 20% non-refundable deposit, proof of funds, and a credit check to enter into a Purchase Agreement for the I/DD Unit I am reserving.


Reference

A reference from an individual that knows your family and the individual with IDD that will reside in the IDD Unit you will be reserving is a requirement of this Application.

Deposits and Fees

The following deposits and fees are required to complete an Application to Reserve an IDD Unit, a Reservation Agreement, and a Purchase Agreement for an IDD Unit in Magnolia Oaks. All fees and deposits are estimates and are to subject to change.

iStrive Membership (Annual)

$500


  • Due upon completion of this Application then annually thereafter, payable to iStrive. Dues help offset the ongoing operating costs of iStrive.

  • You may cancel your membership at any time, but no refunds will be provided. Cancellation of your membership will result in termination of your Application or Reservation Agreement.

  • For members that purchase an IDD Unit in Magnolia Oaks, dues will be included in the HOA fee for your Unit upon move-in. Other members will continue to pay annually with the payment method on file.


Navigator Program Fee

$1,000


  • Due upon completion of this Application, payable to Three Oaks Community Builders L3C. The Navigator Program fee is non-refundable if your Application is approved.

  • The Navigator Program includes customized training, assistance in implementing the reservation process, support developing the IDD HOA budget and bylaws, and other topics upon request. 

  • Families that complete the Family Training Component of the Program will receive a $500 HOA credit at closing. If the family does not close on the Unit they reserved, this credit will be forfeited.


iStrive Foundation Fee

$3,000


  • Due upon execution of a Reservation Agreement, payable to iStrive. This fee is refundable until execution of a Purchase Agreement.

  • The Foundation Fee covers start-up and ongoing operating costs of iStrive, ongoing family education, community building activities, and supportive amenities and programming for our IDD residents.


Design Fee

$2,000


  • Due upon execution of a Reservation Agreement, payable to Three Oaks Communities.

  • The Design Fee is for services provided by the TOC design team, which includes TOC principals, an architect, and an interior designer. The design fee is credited against actual costs incurred by TOC to change the layout of an IDD Unit or common areas within an IDD Home, and assist with interior selections and finishes.

  • The Design Fee is refundable if your Application is cancelled before the design process starts. Design sessions with IDD homebuyers generally commence within 60-90 days after execution of a Reservation Agreement.


Reservation Deposit

$5,000


  • Due upon execution of a Reservation Agreement, payable to TOC's chosen title company and held in escrow.

  • The Reservation Deposit will be held in escrow and applied towards the 20% deposit due at the time a Purchase Agreement is signed.

  • The Reservation Deposit is refundable if a family cancels their reservation before executing a Purchase Agreement.


Purchase Agreement Deposit

20% of Final Price


  • Due upon execution of a Purchase Agreement, payable to TOC's chosen title company and held in escrow.

  • The Purchase Agreement Deposit, inclusive of the Reservation Deposit, will be held in escrow and applied towards the purchase price of the Unit at closing.

  • All deposits are non-refundable after a Purchase Agreement is signed if the Buyer elects not to close on their Unit.


Signature

By signing below, I certify that the information provided is accurate and complete to the best of my knowledge, and that any material misrepresentations may result in my Application or Reservation Agreement being subsequently denied by the HOA.


I also consent to allow TOC to obtain credit information, criminal history and related information regarding the Applicant(s) for the purpose of determining whether or not to enter into a Reservation Agreement with the Applicant(s). Applicant(s) understand that TOC shall have a continuing right to review Applicant's credit information, criminal background history, and related information prior to entering into a Purchase Agreement for a Unit in any of its neighborhoods.
